Agreement to Terms
Welcome to Road Warrior Towing! These Terms of Service ("Terms") govern your use of our website and our towing and roadside assistance services in the Grand Rapids, Michigan area. By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.
Our Services
Road Warrior Towing provides professional towing and recovery services, including but not limited to:
- 24/7 emergency towing
- Vehicle transport (local and long-distance)
- Roadside assistance (jump starts, tire changes, lockouts, fuel delivery)
- Wrecker and recovery services
- Flatbed towing
- Motorcycle towing
- Accident recovery
Service descriptions, pricing, and availability are subject to change without notice. We reserve the right to modify or discontinue any service at any time.
Service Requests and Dispatch
Requesting Service
Services can be requested by calling our dispatch line at (616) 241-6053. When requesting service, you must provide accurate information including your location, vehicle details, and the nature of your situation.
Response Time
While we strive for fast response times, actual arrival times may vary based on location, traffic conditions, weather, and call volume. Response time estimates are not guarantees.
Service Area Business (SAB)
Road Warrior Towing serves customers across the Grand Rapids metro area and surrounding communities. Map displays and location pages represent service coverage and dispatch areas; they do not guarantee availability for every address at every moment. Please call dispatch to confirm coverage and the appropriate equipment for your vehicle.
Cancellation
- You may cancel a service request before the tow truck arrives
- Cancellation fees may apply if the truck has been dispatched and is en route
- If we arrive on scene and you refuse service, a service call fee may be charged
Payment Terms
- Payment is due upon completion of services unless otherwise arranged
- We accept Cash, Credit Card, Debit Card, Venmo, Zelle, Apple Pay
- Prices quoted are estimates and may vary based on actual distance, vehicle type, and situation
- Additional charges may apply for after-hours service, difficult recoveries, or specialized equipment
- All prices are in USD and subject to applicable Michigan sales tax
- Insurance coverage: If you have towing coverage through your insurance or motor club, coverage and billing depend on your plan and approval requirements
- We reserve the right to refuse service if payment cannot be secured
Vehicle Custody and Release
Authorization
You must be the vehicle owner or have proper authorization to request towing services. We may require proof of ownership or authorization before releasing a vehicle. For accident tows, police authorization may be required.
Personal Belongings
We are not responsible for personal belongings left in vehicles. You should remove all valuables before or immediately after towing. We recommend taking photos of your vehicle and its contents before towing.
Vehicle Storage
If your vehicle is towed to our storage facility, daily storage fees will apply. Vehicles must be claimed during business hours with proper identification and payment. Michigan lien laws apply to unpaid storage fees.
Liability and Insurance
Our Responsibility
Road Warrior Towing maintains insurance coverage as required by Michigan law. We take every precaution to protect your vehicle during towing and transport. However, we are not responsible for:
- Pre-existing damage to your vehicle
- Damage to extremely low-clearance vehicles towed without flatbed service
- Damage to improperly maintained or modified vehicles
- Damage to loose, unsecured, or aftermarket parts
- Mechanical or electrical failures unrelated to towing
- Damage resulting from failure to follow our instructions
- Loss or theft of personal property left in vehicles
- Damage from acts of God, riots, or civil unrest
Damage Claims
If you believe your vehicle was damaged during our service, you must notify us within 24 hours and provide photographic evidence. Claims must be filed in writing within 7 days. We will investigate all legitimate claims and work with our insurance carrier as appropriate.
Safety and Cooperation
For everyone's safety, you agree to:
- Provide accurate location and vehicle information
- Follow our operator's safety instructions
- Move to a safe location away from traffic
- Not interfere with towing operations
- Treat our operators with respect and professionalism
- Disclose any hazardous materials or special conditions
We reserve the right to refuse service to customers who are intoxicated, abusive, threatening, or create unsafe conditions.
Indemnification
You agree to indemnify and hold Road Warrior Towing, its owners, employees, and agents harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of our services, your violation of these Terms, or your violation of any rights of another party.
Disclaimer of Warranties
Our services are provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our services will be uninterrupted or error-free.
Limitation of Liability
To the fullest extent permitted by Michigan law, Road Warrior Towing's total liability for any claim arising from our services shall not exceed the amount you paid for the specific service in question. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, loss of use, or loss of data.
Dispute Resolution and Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions. Any disputes arising from these Terms or our services shall first be attempted to be resolved through good-faith negotiation.
If negotiation fails, any legal proceedings shall be conducted exclusively in the courts of Kent County, Michigan. You consent to the personal jurisdiction of these courts and waive any objection to venue.
Emergency Services Disclaimer
While we provide 24/7 emergency towing services, we are not a substitute for 911 emergency services. In medical emergencies, fires, or situations involving immediate danger, always call 911 first before requesting towing services.
Photography and Documentation
We routinely photograph vehicles before and after towing for documentation and liability protection. By using our services, you consent to this documentation. We may use photos for training, quality control, and marketing purposes. Vehicle license plates may be blurred in marketing materials.
Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
